1. Scope & Authority
The City of Fillmore enforces backflow prevention and cross‑connection control to protect its potable water supply from contamination. These measures are implemented under the authority of the State of California’s Health & Safety Code, the State Water Resources Control Board’s Cross‑Connection Control Policy Handbook (CCCPH), and through Ventura County’s cross‑connection / backflow prevention program. Ventura County’s Environmental Health Division provides regulatory oversight of cross‑connection control in coordination with public water purveyors. 2. Responsibilities of Property Owners
Installation & Maintenance: Property owners must install and maintain approved Backflow Prevention Assemblies (BPAs) or other suitable devices at service connections or internal cross‑connections where potential hazards are identified.
Annual Testing: BPAs must be tested at least once per year by a certified backflow prevention tester. Property owners are responsible for ensuring timely testing. Repairs & Replacements: If a BPA fails its test, it must be promptly repaired or replaced by a certified tester to restore compliance.
Reporting: Test results — including for installations, replacements, repairs, relocations, and annual tests — must be submitted through the designated reporting system (e.g. Ventura County Citizen Access or the water purveyor's portal). 3. Scenarios Requiring Backflow Prevention Assemblies (BPAs) The City expects BPAs (or equivalent protection) in situations including but not limited to: Irrigation systems Fire sprinkler / suppression systems Auxiliary or alternate water sources (e.g. wells, cisterns) Commercial, industrial, or process water systems with contamination risk Any internal plumbing or cross‑connection that cannot be eliminated or adequately controlled
4. Testing & Maintenance Requirements
Mandatory Testing Events: Testing is required upon installation, after repair, after relocation, and at least annually thereafter. Ventura County Public Works Agency Submission of Test Reports: Test results must be submitted via the designated online system (e.g. Ventura County Citizen Access, or the purveyor’s portal). After July 1, 2025, many purveyors will take over direct management of test result submissions. Repairs / Replacements: Devices failing tests must be repaired or replaced before further use. Only certified testers may perform the work. All costs are borne by the property owner.
5. Approved Devices & Certified Testers
Approved Devices: Only backflow prevention assemblies that meet recognized industry standards (e.g. AWWA, USC / Foundation for Cross‑Connection Control) should be used. Lead‑free device requirements per state law may apply.
Certified Testers: After the regulatory changes, testers must hold certification from an ANSI‑accredited certification body and be registered with Ventura County or the water purveyor’s backflow program. 6. Enforcement & Penalties
Non‑Compliance: Failure to install, test, or maintain required BPAs may result in administrative enforcement actions, including notices of violation and potentially water service discontinuation until compliance is achieved.
Penalties: Late submission of test results, failure to repair a failed device, or refusal to comply may incur penalties, late fees, or other enforcement measures under county or city authority.
